Truck Accident Attorney: Safety Violations Can Lead to a Shutdown Order for Trucking Company

The Lubbock truck injury attorneys at Fadduol, Cluff & Hardy, P.C. represent victims of serious truck accidents. Many truck accidents are caused by a trucking company’s violation of safety standards. A victim of such an accident must cope with more than just the physical and mental pain associated with the wreck. The victim must also cope with the knowledge that the wreck could have been prevented if the trucking company had simply followed the rules designed to protect its employees and other motorists.

The federal government has created an agency to investigate safety violations and to stop trucking companies from committing serious infractions. The U.S. Department of Transportation’s Federal Motor Carrier Safety Administration investigates trucking companies’ safety violations. It even shuts down trucking companies if serious safety violations are uncovered.

FMCSA recently ordered Kansas-based commercial truck company HP Distribution LLP and an affiliated company, HP Distribution LLC, to immediately cease all transportation services. FMCSA found that these companies had committed serious safety violations that posed an imminent hazard to public safety.

FMCSA investigators found a range of serious safety violations. For example, the company knowingly permitted its truck drivers to falsify the number of hours they drove in an attempt to conceal hours-of-service violations. The company also sent potentially fatigued drivers on interstate trips, disregarding the safety of the truck drivers and other motorists.
