A wrongful death cause of action is a claim brought by the beneficiaries (spouse, children, or parents) of a person who was killed due to the negligence of another person or entity. The beneficiaries maybe entitled to recover money to compensate them for their loved one’s death. For example, the beneficiaries may seek compensation for pecuniary loss, loss of companionship and society, mental anguish, loss of inheritance, and exemplary damages.

When a loved one dies, (because of a wrongful death), the grieving family members may not consider how the death affects their legal rights. The family, simply, may not be ready to deal the reality of the loss and may therefore forget or ignore their rights under the law. However, in Texas, with few exceptions, the beneficiaries must file a lawsuit to recover wrongful death damages within two years after the decedent’s date of death. After this time period elapses, the beneficiaries may lose their rights under the law. When a loved one dies as a result of the negligent conduct of another, a beneficiary or loved one should contact an attorney immediately. Cases often turn on the preservation of key evidence. The longer that evidence is left unpreserved the easier it is for it to become lost or destroyed.
