Queens, New York (NewYorkInjuryNews.com) — On April 18, 2008, David J. Dean, Esq., of Sullivan Papain Block McGrath & Cannavo, PC, won $1,250,000.00 from a Queens County jury on behalf of a 41 year old woman who sustained serious injuries during surgery.
On January 12, 2005, our client underwent a radical hysterectomy surgery because she had been diagnosed with an early stage of cervical cancer. During the surgery, the patient suffered injuries to her ureters and sustained a puncture to her colon, resulting in a fistula. As a result of these injuries, the plaintiff required a colostomy for 8 months and, over the course of one year, underwent numerous surgical procedures to repair the injuries.
After investigating the case, Sullivan Papain Block McGrath & Cannavo P.C. started a lawsuit on behalf of the plaintiff against her surgeon. Mr. Dean argued that the surgeon inadvertently perforated the plaintiff’s ureter. While acknowledging that such an action was a risk of the procedure, Mr. Dean submitted evidence that the surgeon was negligent in failing to properly inspect the ureters. Had such an inspection been performed, the injuries would have been treated without the complications that the patient endured.
At trial, the defendant claimed to have inspected the patient’s bowels and ureters before suturing her closed. The jury took only three hours to return a verdict against the surgeon, finding him 100% liable for the plaintiff’s injuries. The jury awarded our client a total of $1,250,000.00 in past and future damages.
