San Jose, California – Apple demanded $380 million on Wednesday from Samsung over the purported copying of iPhone and iPad features. As reported by the Associated Press (AP), the demand was made by an attorney for Apple during opening statements, which also included a video of the first iPhone being unveiled by Apple founder Steve Jobs in 2007 at the Macworld conference in San Francisco.
Apple attorney Harold McIhenny is quoted by the AP as stating, “Apple lost sales because Samsung was selling infringing products.”
Apple was awarded $1.05 billion by a previous jury after determining that several Samsung products had infringed Apple patents. A judge subsequently determined $400 million in damages had been miscalculated by the jury.
Notre Dame law school professor Mark McKenna is quoted by the AP as stating of the high profile ongoing legal battle, “Most cases with these enormous stakes would have settled by now — particularly once the court ordered a new trial on damages, which could substantially increase or decrease the damage award.”
