Marriage petition dismissed by judge because man can’t speak

Rockford, Illinois – A judge in Winnebago County dismissed a marriage petition of a woman seeking to marry her fiancé who is unable to speak due to a brain injury. As reported by the Rockford Registered Star, Judge Lisa Fabiano determined that the man, John Morris, who suffered a severe brain injury in 2009, was unable to comply with consent requirements in accordance with state law to marry Colette Purifoy.

Purifoy, who is legal guardian of the estate of Morris, has been in a relationship with him for approximately 38 years. Morris is confined to a bed in their home in Machesney Park under 24 hour nursing care.

Fabiano previously authorized a marriage license between Moris and Purifoy; however, it was refused by Winnebago County Clerk Margie Mullins.

Mullins is quoted as stating of the matter, “You have to take everything else out of the equation. All you can look at is what does the law say you can do, and cannot do… I’m sorry, but I was elected into this office to uphold the laws that run that office.”
