Pa. state officials seek to stop issuance of gay marriage licenses by county

Philadelphia – State officials in Pennsylvania filed a lawsuit to stop the issuance of gay marriage licenses in Montgomery County. As reported by the Associated Press (AP), the Health Department filed the petition after D. Bruce Hanes, the register of wills in the county, began granting the licenses in violation of state law.

As noted by the AP, 34 licenses had been granted and six-marriages had been registered for same-sex couples by Hanes’ office.

The lawsuit is quoted by the AP as stating, “There is no limit to the administrative and legal chaos that is likely to flow from the clerk’s unlawful practice of issuing marriage licenses to those who are not permitted under Pennsylvania law to marry.”

County solicitor Ray McGarry stated Tuesday that licenses will continue to be granted to gay couples as litigation on the matter is pending.
