Texas judge refuses Lance Armstrong lawsuit dismissal request

Austin, Texas – A Texas judge has refused to dismiss an insurance company’s lawsuit seeking the recovery of $3 million in bonuses previously paid to the former professional cyclist. As reported by the Associated Press (AP), an attorney for Nebraska-based Acceptance Insurance Holdings stated he would move swiftly to question Armstrong under oath.

Acceptance had a contract with Armstrong under which the cyclist would be paid bonuses for winning races including the Tour de France. The company filed a lawsuit to recover bonuses paid from 1999-2001 following Armstrong’s admission that he had used performance-enhancing drugs for several years to win races.

Attorneys for Armstrong sought to have the lawsuit dismissed claiming that the statute of limitations for breach of contract or fraud claims had expired.

Travis County judge Darlene Byrne ruled Monday that the case could proceed.
