New York – A judge has struck down a ban on the sale of sugary drinks, like sodas, larger than 16 ounces in restaurants in New York City. As reported by the Associated Press (AP), State Supreme Court Justice Milton Tingling made decision Monday, only hours prior to the measure taking effect.

Tingling is quoted as writing of his decision, “The loopholes in this rule effectively defeat the stated purpose of this rule.”

Mayor Michael Bloomberg is further quoted as stating in opposition of the ruling, “We believe the judge is totally in error in how he interpreted the law and we are confident we will win on appeal… One of the cases we will make is that people are dying every day. This is not a joke. Five thousand people die of obesity every day in America.”
