Lawsuit: Overstock.com Accused of Fabricated Prices, Overstated Discounts

Los Angeles, CA—Online retail giant, Overstock.com, is being sued by a group of California attorneys for allegedly overstating its deals and misleading its consumers. The $15 million false advertising lawsuit was filed in Alameda County Superior Court on Wednesday, November 17, 2010, as reported by CNN Money.

The lawsuit asserts that Overstock.com should pay at least $15 million in fines and restitution for “routinely and systematically” making inaccurate and misleading claims about the prices of its advertised products.

According to the filings, “Overstock allegedly advertised a patio set $449.99 and claimed that the ‘List Price’ for the set was $999. But the furniture arrived with a Wal-Mart sticker showing the price to be $247.” Overstock is being accused of fabricating “list prices” and “compare at prices.”

Overstock fought back by stating, “Overstock.com stands by all our advertising practices, including providing comparison values which we thoroughly explain on our site,” stated Jonathan Johnson, President of Overstock.com. “We have been singled out for standard industry practices, which we look forward to demonstrating in court.”
