OSHA cites DE company Formosa Plastics for workplace violations: safety, health

Legal news for Delaware employment attorneys – OSHA issued citation to manufacturing company Formosa Plastics Corp. for serious workplace safety and health violations.

Company received citations for 27 alleged serious workplace violations; penalties total $133,500.

Delaware City, DE (www.NewYorkInjuryNews.com) – The United States Labor Department’s Occupational Safety and Health Administration, (OSHA) www.osha.gov, cited Formosa Plastics Corp. of Delaware City for 27 alleged serious workplace health and safety violations, as reported via news release from OSHA.

Of the 27 issues, exposing workers to combustible dust hazards is included among the charges. The penalties total $133,500.

Formosa Plastics Corp. produces plastic resins and petrochemicals. The company employs 98 workers.

An investigation into the workplace began October 1, 2009, in response to an employee complaint.

OSHA issues citations labeled as serious when there is substantial probability that death or serious injury or harm could result, and the employer knew, or should have known of the dangers.

According to OSHA’s report, Formosa Plastics Corp. faces citations for the “company’s failure to properly contain polyvinyl chloride dust particles, evaluate contractors’ safety programs and procedures, properly inspect process equipment, provide fire retardant clothing for employees, require employees to wear adequate eye protection with side shields, provide proper training and provide employees with an infirmary, clinic or person trained in first aid.”

In addition, inspectors found a lack of machine guarding, an inefficient process safety management program, inadequate lockout/tagout procedures for energy sources and unguarded machinery, floor holes and walkways.

Formosa Plastics Corp. has 15 business days from the day of receiving the citations to comply, request an informal conference with an OSHA director or contest the issues.

Under the OSHA Act of 1970, employers are responsible for providing safe and healthy workplaces for employees. OSHA sets and enforces standards, and provides training, outreach, education and assistance towards the efforts of making workplaces safe.
