Spencerville, OH—The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) has proposed $91,000 in penalties after three workplace safety violations were discovered at Ohio Decorative Products. The die cast metal products manufacturer was cited for one willful, one serious, and one repeated violation due to the injury hazards posed by the lack of appropriate guarding on machinery, according to the OSHA press release posted on March 17, 2010.

A workplace accident in which an employee’s hair became entangled in a rotating shaft on a piece of machinery, causing him to be scalped, prompted OSHA to conduct inspection at the producer’s facility in December 2009. Upon doing so, it was discovered that the piece of machinery that caused the worker to suffer injuries lacked protective guarding. Citations were issued with regard to the absence of guarding on equipment used by employees within the manufacturing facility. OSHA has inspected Ohio Decorative Products 12 times, in which the company was cited for a total of 77 workplace safety violations.

According to the news release, “OSHA defines a willful violation as one committed with intentional knowing or voluntary disregard for the law’s requirements, or with plain indifference to employee safety and health. OSHA issues repeat violations when it finds a substantially similar violation of any standard, regulation, rule or order at any other of an employer’s facilities in federal enforcement states after violations have been cited at another facility. An OSHA violation is serious if death or serious physical harm can result from a hazard an employer knew or should have known exists.”
