Alabama jury returns $3.8 million wrongful death judgment

Family of an Alabama State University football player who drowned in a Montgomery hotel pool recovered a $3.8 million wrongful death judgment. The family was celebrating a reunion at the former King’s Inn hotel when the 19 year-old ball player drowned in the cloudy pool waters.

Montgomery, AL–The family of a Wetumpka High School graduate who signed with the Alabama State University Hornets in 2007 recovered a $3.8 million verdict in the young ballplayer’s wrongful death lawsuit. According to the MontgomeryAdvertiser, 19 year-old Derrick Marshall died in the Rodeway Inn, formerly known as King’s Inn, while swimming in the Montgomery hotel pool during a family reunion on July 29, 2007.

The Alabama personal injury lawyers litigating the wrongful death claim for the Marshall family stated the Montgomery County Health Department had closed the hotel pool located on West South Boulevard but hotel employees told the celebrating Marshall family the pool could be used anyway. Young Marshall who was ready to begin two-a-day workouts in pre-season practice for the Alabama State University football team was found dead at the bottom of the murky pool waters. He was revived by emergency medical services personnel (EMS) and transported to Jackson Hospital where he died from his pool injuries on November 20, 2007. The young man never recovered from a vegetative state. The lawsuit was filed by Alabama wrongful death attorneys representing the grieving family on Setpember 7, 2007 and named the former King’s Inn hotel, a general manager and a woman named Tamara Mitchell.
