Lawsuit: Teen with Down Syndrome Sexually Assaulted at Canton Township School

Canton Township, MI — The mother of a teenager with special education needs has sued Plymouth-Canton Community Schools, after another student at Discovery Middle School allegedly sexually assaulted her daughter on numerous occasions, reported the Detroit Free Press.

The lawsuit, which was filed in Wayne County, named the district, along with several district employees: Joslyn Clark, supervisor of special education; Julie Woodhams, director of special education; Amy Carns, a special education teacher at Discovery Middle; Roche LaVictor, principal at Discovery Middle and Terry Sawchuk, assistant principal at Discovery.

Each person was charged with gross negligence for failing to prevent the alleged sexual assaults.

The lawsuit asserts that the 15-year-old teen, who suffers from Down syndrome, had repeatedly been sexually assaulted by a boy in a cognitively impaired program classroom, and during gym class in an unlocked room off of the gym area.

The boy, who remains unidentified, has been charged by the Wayne County Prosecutor’s Office.

The lawsuit is seeking an excess of $25,000 from the school district and each person named in the lawsuit.
