Westchester, NY - New lawsuit for Toyota

Legal news for New York product liability attorneys - Westchester family filing suit against Toyota over 2008 crash that took life of 5-year-old.

Family claiming acceleration problems in Lexus caused death of 5-year-old son, filling lawsuit.

Westchester, NY – A Cortland Manor couple is suing Toyota for a crash that occurred in 2008 which resulted in a 5-year-old boy’s death, as reported by New York Post. Daniel and Nancy Murtha claim the automaker already knew in 2008 that it had problems with the electronic system in its cars but tried to hide the problems rather than fix them.

Nancy Murtha, mother of now deceased Jake, was driving a Lexus RX350 on July 29, 2008, and experienced acceleration problems that resulted in the car slamming into a wall.  A prepared statement cites Nancy as saying, “As I hit the brake, the car wouldn’t stop. It just kept on going.” She was trying to pull the car over to help Jake with something.

The boy died several hours after the crash at Westchester County Medical Center. As stated in the lawsuit, Nancy Murtha was in a coma for six days and suffered severe injuries to her neck, back, right knee and hip. Doctors also removed her spleen and part of her intestines.

Toyota is facing over 80 lawsuits over sudden acceleration claims. The company denies that electronic problems have anything to do with the acceleration issue. The Lexus RX350 has never been part of the recall of eight million vehicles.
