December 16, 2009 (NewYorkInjuryNews.com - New York City, Product Liability)

Harley Davidson recalled motorcycles for defect.

Legal news for New York Product Liability attorneys– Harley Davidson informed NHTSA that motorcycle fuel tanks could leak and pose an injury or liability hazard.

New York, NY (NewYorkInjuryNews.com) — Harley Davidson informed the National Highway Traffic Safety Administration (NHTSA) www.nhtsa.gov that the company discovered a defect that could affect 111,600 motorcycles which are being recalled for consumers safety, announced the New York Times, December 11, 2009.

Harley-Davidson recalled the 2009-10 Touring, CVO and Trike motorcycles due to a hazard in which the fuel tanks may leak after a severe crash and could cause “fire, injuries, or fatalities.”

Subaru has also recalled 5,700 of its 2002-03 Impreza WRX models due to a potential fuel leak hazard that could cause a fire under “extremely cold temperatures” according to a safety organization. Subaru had received 944 complaints from consumers who reported a fuel leak or the smell of gas. There was also one report of a fire.

The Subaru company sent out a letter to the agency reporting that the vehicles “do not contain a safety related defect within the meaning of federal motor safety law.” The company said that it recalled the vehicles only to relieve the owners and NHTSA of its concerns.

The safety agency permitted the recall to affect only the cold weather states such as: New York, South Dakota, Nebraska, Maine, North Dakota, New Hampshire, Minnesota, Idaho, Iowa, Montana, Colorado, Wisconsin, Wyoming, Michigan, Alaska, and Vermont.

If owners in any of the other states notice the smell of gasoline, they are advised to take the motorcycle to a dealer for the recall.
